These Terms and Conditions ("Terms", "Terms and Conditions") govern your relationship with the Roots Care App mobile application (the "Service") operated by Roots Care establishment in Saudi Arabia and ROOTS CARE HOME HEALTH SERVICES in United Arab Emirates ("us", "we", or "our"). Please read these Terms and Conditions carefully before using our Roots Care App mobile application (the "Service"). Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.
If you wish to purchase any product or service made available through the Service ("Purchase"), you may be asked to supply certain information relevant to your Purchase including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and your shipping information. You represent and warrant that: (i) you have the legal right to use any credit card(s) or another payment method (s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct, and complete. By submitting such information, you grant us the right to provide the information to third parties for purposes of facilitating the completion of Purchases. We reserve the right to refuse or cancel your order at any time for certain reasons including but not limited to product or service availability, errors in the description or price of the product or service, error in your order, or other reasons.
- We accept payments online using Visa and Master Card credit/debit cards and Mada Card in SAR and the UAE dirham.
- Refunds will be done only through the Original Mode of Payment.
We are constantly updating our offerings of products and services on the Service. The products or services available on our Service may be mispriced, described inaccurately, or unavailable, and we may experience delays in updating information on the Service and in our advertising on other websites. We cannot and do not guarantee the accuracy or completeness of any information, including prices, product images, specifications, availability, and services. We reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice.
You have a legal right to receive services that comply with their description, which are of satisfactory quality, and which comply with any specific requirements you tell us about (and we agree to) before you place your order. If you believe that the Items you have received did not comply with these legal rights, please let us know immediately to acknowledge. We may request a photo showing the problem if it is something that can be seen by inspecting the Items. We will provide a refund or account credit or deposit the amount into your wallet account of Roots Care application, in respect of the affected part of the Item, if the whole order was affected unless we have reasonable cause to believe that the problem was caused after providing the service. Prior to processing your refund or account credit, we may consider relevant factors including the details of the service, your account history, what happened on providing the service, and information from the Partner Service Provider.
You may cancel an order without charge at any time before the Service Provider Partner has accepted to start the service (a “Pending Order”), please cancel immediately, via Roots Care Application. If the service provider's assignment order is (“accepted order”), no order can be canceled after the pending order becomes accepted, and the full price of the items will be charged. For any order requested on a cash on delivery (“COD”) payment or online payment card basis, or from your wallet balance at Roots Care application, such order may not be canceled after it becomes an Accepted Order and will be charged and executed to you. In return, ROOTS CARE and/or the Partner Service Provider may notify you that an order has been canceled at any time. In this case, you will not be charged for any orders canceled by us or the Partner Service Provider, and we will reimburse you for any payment already made using the same method you used to pay for your order.
The process of recovering the amount for the customer’s account through the prepaid / credit card payment gateway may take two working days. From the notice of refunding the printed amount from the prepaid / credit card payment gateway as a reference for it in the event that the customer wants to review the bank. Customers who use the prepaid / credit card payment service are required to be present on their contact numbers.
ROOTS CARE uses dynamic pricing running all of the time, the total price of your order will be set out on the checkout page on our application, including the prices of Services and Delivery and applicable Service Fees and taxes, which includes the following details: -
- Quantity of items and types
- Price per unit, as per Service Provider Partner’s price list as described on the ROOTS CARE application.
- Delivery fees to the customer's site in case there are delivery fees.
- Value Added Tax charges per item and service inclusive 15% of total value provided by ROOTS CARE.
- Time and date set of Order placement.
- Gross invoice value requested to be settled by the customer.
which means that the prices of services and delivery may change during browsing. Prices can be changed at any time at the discretion of the partner service providers, and delivery charges fees in line with the distance from the service provider to the customer's request site as well. We reserve the right to charge a delivery Service Fee, which may be subject to change, for the provision of our Services. You will be notified of any applicable Service Fees and taxes prior to purchase on the checkout page of the ROOTS CARE Application.
The service provider may charge additional fees if the customer added a “special request” or “general order” to His request, and these additional requests will be paid in cash upon performing the service.
All prices submitted according to the bill issued on the ROOTS CARE application are identical to the claim according to the invoice for the service provider in addition to VAT. No changes will affect existing confirmed orders unless there is an obvious pricing mistake. Nor will changes to prices affect any orders in process and appearing within your basket, provided you complete the order while you are creating the basket. If you do not conclude the items while creating the order, the items will be removed from your basket automatically.
If there is an obvious pricing mistake, we will notify you as soon as we can and you will have the choice of confirming the order at the original price or canceling the order without charge and with a full refund of any money already paid directly to your wallet account into ROOTS CARE application, on which can be reused for a limited period of six months from last transaction deposit date. Payment for all services’ prices and delivery fees can be made on our application by cash on delivery, credit or debit card, or Wallet balance used to deduct the full amount, if possible, or other payment methods made available by ROOTS CARE. Once your order has been confirmed, your credit or debit card will be authorized, and the total amount marked for payment (in respect of all payments made by credit or debit cards).
Payment is made directly to ROOTS CARE acting as an agent on behalf of the Partner Service Provider only. Payment may also be made by using account credit. Use of these is subject to ROOTS CARE Account Credit Terms. Where COD is possible, this will be made clear on our application before you place your order. Only cash payments will be accepted when an Order is to be delivered under the COD facility.
Where online bank payment cards (Debit or Credit Card) are possible, this will be made clear on our application before you place your order. Only bank cards will be accepted when an Order is to be delivered under the online bank payment cards facility.
We will not be authorized to accept cheques, credits, vouchers, card payments, or any other forms of payment (including credit or debit cards) once an Order is requested through the COD payment on our Service. The Service Provider will only carry a small amount of change, so for all COD payments, you are requested to prepare the exact payment or as close to it as possible for the Order (as you may not receive change back). We are authorized by our Partner Service Providers to accept payment on their behalf and payment of the price of any Services or charges to us will fulfill your obligation to pay the price to the Partner Service Provider.
Partner Restaurants sometimes make special offers available through our application. These are visible when you look at a Partner Restaurant menu only via the ROOTS CARE Application. These offers are at the discretion of the Partner Restaurants. Unless the offer terms state a fixed or minimum period for which an offer will be available, it can be withdrawn at any time, unless you have already placed an order based on the offer and we have sent you the Confirmation Notice.
When you create an account with us, you must provide us with information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service. You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account. You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you without appropriate authorization, or a name that is otherwise offensive, vulgar or obscene.
The Service and its original content, features, and functionality are and will remain the exclusive property of Roots Care establishment and ROOTS CARE HOME HEALTH SERVICES its licensors. The Service is protected by copyright, trademark, and other laws of both Saudi Arabia and the United Arab Emirates and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Roots Care.
Our Service may contain links to third-party websites or services that are not owned or controlled by Roots Care. Roots Care has no control over and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that Roots Care shall not be responsible or liable, directly, or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services. We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.
In no event shall Roots Care nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damages, and even if a remedy set forth herein is found to have failed of its essential purpose.
Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether expressed or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. Roots Care of its subsidiaries, affiliates, and licensors do not warrant that a) the Service will function uninterrupted, secure, or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components, or d) the results of using the Service will meet your requirements.
These Terms shall be governed and construed in accordance with the laws of Saudi Arabia, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have between us regarding the Service.
- All credit/debit card details and personally identifiable information will NOT be stored, sold, shared, rented, or leased to any third parties.
- Saudi Arabia is our country of domicile Website will NOT deal or provide any services or products to any of OFAC (Office of Foreign Assets Control) sanctions countries in accordance with the law of Saudi Arabia
- Any dispute or claim arising out of or in connection with this website shall be governed and construed in accordance with the laws of Saudi Arabia.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by their vised terms. If you do not agree to the new terms, please stop using the Service.
